Once again, Democrats are showing that they care more about criminal illegals than they do about law-abiding citizens.

Via the New York Post:

“A small change in New York’s criminal law will spare thousands of illegal immigrants and green-card holders from being deported, detained or denied citizenship, officials said Friday.

Gov. Cuomo and the state Legislature agreed to reduce the maximum jail sentence for some Class A misdemeanors from 365 days to 364.

Under federal immigration law, certain minor convictions punishable by at least a year in jail could lead to deportation.

The change will “protect thousands of New Yorkers from these unnecessary, harsh immigration consequences,” the Immigration Defense Project said.

Typical Class A misdemeanors include shoplifting, bad checks, counterfeit goods, and false advertising.

Currently, for example, a green card holder who has a single conviction for a first-time shoplifting misdemeanor could face deportation based on federal immigration law.

Under the New York amendment, immigrants could still face deportation for other more serious Class A misdemeanors of “moral turpitude” — drug offenses, child abuse, domestic violence or a firearms offense.

Prosecutors and judges will continue to have discretion on charging and sentencing of immigrant defendants.

Currently, 40 percent of New Yorkers with Class A misdemeanor convictions are given non-jail sentences such as probation or conditional discharge.”
